General Terms and Conditions

These terms describe the current legal baseline for the use of en4ce. They are written defensively for the current operator model and should be aligned with the final commercial setup before broad productive rollout.

1. Scope

These terms apply to the use of the en4ce platform.

2. Service description

en4ce is a platform for evaluating and analyzing data from existing systems, especially in IT service management and ticket tracking.

A specific scope of features or permanent availability is not guaranteed.

3. Contract conclusion during the pilot phase

(1) The presentation of services on the website does not constitute a legally binding offer, but a non-binding invitation to submit a request.

(2) By submitting an order, the customer submits an offer or a request.

(3) For orders with a monthly total price above EUR 100, the contract is concluded only after individual coordination and explicit confirmation by the provider.

(4) The provider reserves the right to reject or adjust requests during the pilot phase.

4. Use

Use of the platform is at the user's own responsibility.

The user must ensure that they are entitled to process the data used with the platform.

5. Availability

There is no entitlement to uninterrupted availability at all times.

6. SLA rules during the pilot phase

Service level agreements (SLA) during the pilot phase

(1) The provider offers defined service level agreements (SLA) as part of its services, in particular for response and processing times.

(2) The customer acknowledges that the product is in a pilot phase. During this phase, deviations from the defined SLA may occur due to further development, technical adjustments, or increased workload.

(3) During the pilot phase, the SLA are target values and not guaranteed response or processing times.

(4) The provider strives to comply with the agreed SLA as closely as possible and to improve service quality continuously.

(5) Claims for contractual penalties, reduction, or damages resulting from non-compliance with SLA exist during the pilot phase only in cases of intent or gross negligence on the part of the provider.

7. Liability

To the extent permitted by law, liability is limited to intent and gross negligence.

No liability is assumed for data loss or consequential damage.

8. Privacy

The privacy notice applies.

9. Changes

Changes to the platform and these terms may be made at any time.
